ISLAMABAD: According to Justice Mansoor Ali Shah, the dispute concerning the bench’s jurisdiction has nothing to do with the 26th Amendment to the Constitution. He further stated that if someone is afraid on their own, that is a different issue.
In reference to the non-scheduling of a case on the powers of benches, he made these comments at a contempt of court hearing on Wednesday. Justice Shah leads the two-member bench, which also includes Justice Aqeel Ahmed Abbasi.
The matter at hand concerns the incorrect case-fixing by Additional Registrar (Judicial) Nazar Abbas, who has since been removed from his position, which included a challenge to the authority of the Custom Act 1969. Abbas incorrectly fixed cases intended for the Supreme Court’s constitutional bench rather than a regular one.
