ISLAMABAD: Supreme Court constitutional bench member Justice Musarrat Hilali has inquired as to what penalties an army officer would face for suspending the Constitution.
The judge made these comments on Monday at a hearing on appeals against civilians being tried in military courts. The session was chaired by a constitutional bench headed by Justice Amin-Ud-Din Khan.
The Ministry of Defense’s attorney, Khawaja Haris, made arguments, stating that the Supreme Court had ruled that Section 59(4) of the Army Act was void as well.
According to Justice Jamal Khan Mandokhail, military officers are subject to all of the offenses listed in the Army Act. In response, Haris contended that Section 31-D of the Army Act, which recognizes military tribunals under the constitution, applies to trials of civilians.
