ISLAMABAD: During the hearing of intra-court appeals against the rulings of military courts on Thursday, Supreme Court Justice Jamal Khan Mandokhail questioned the validity of judging civilians under the disciplinary framework of the armed forces.
The appeals were heard by the seven-member constitutional bench, which was presided over by Justice Aminuddin Khan. In addition, Justices Mandokhail, Muhammad Ali Mazhar, Syed Hasan Azhar Rizvi, Naeem Akhtar Afghan, Musarrat Hilali, and Shahid Bilal Hassan were on the bench.
Senior attorney Khawaja Haris, speaking for the federal government, contended that Article 8 of the Constitution is at the center of the proceedings.
Justice Mandokhail, however, brought up important points, such as “How can an individual who is not a member of the armed forces fall under its disciplinary code?”
